Shipping & Returns

1. Definitions

Carrier: Refers to the company or individual responsible for the transportation of goods.

Shipper: The person or entity who arranges for the transportation of goods.

Consignee: The person or entity to whom the goods are being shipped.

Goods: The items being shipped under this agreement.

2. Acceptance of Terms

By using our shipping services, the Shipper agrees to the following Terms and Conditions, which will apply to all shipments unless explicitly agreed otherwise in writing.

3. Shipping Rates and Fees

Shipping rates are based on the weight, dimensions, destination, and type of goods.

Any additional fees, including but not limited to customs duties, taxes, and storage fees, are the responsibility of the Shipper or Consignee unless otherwise agreed.

The Carrier reserves the right to adjust rates based on fluctuating fuel prices, changes in regulations, or any unforeseen circumstances.

4. Payment Terms

Payment for shipping services is due as per the agreed terms between the Shipper and the Carrier. Standard payment terms are [30 days] from the date of the invoice unless otherwise stated.

Late payments may incur interest at the rate of [X]% per month after the due date.

5. Insurance

The Carrier is not responsible for providing insurance for the Goods. Shippers are responsible for insuring the Goods for transit if they so choose.

In the event the Shipper wishes to declare a higher value for the Goods, the Shipper must make arrangements with the Carrier in writing.

6. Liability for Loss or Damage

The Carrier’s liability for loss or damage to Goods shall be limited to [Insert amount] per kilogram or [Insert amount] per shipment unless a higher value is declared and additional charges are paid.

The Carrier will not be liable for any indirect, special, or consequential damages, including loss of profits, even if the Carrier had been advised of such damages.

The Carrier will not be responsible for loss or damage caused by events beyond its control, including but not limited to natural disasters, war, strikes, or delays caused by third parties.

7. Packaging and Labeling

The Shipper is responsible for ensuring that the Goods are properly packaged to prevent damage during transit.

The Shipper must provide accurate and legible labeling for the shipment, including any special handling instructions.

8. Prohibited Items

The Shipper must not ship any prohibited or restricted items, including but not limited to:

Hazardous materials (unless prior arrangements have been made)

Perishable goods (unless prior arrangements have been made)

Illegal substances or contraband The Carrier reserves the right to reject or dispose of any prohibited items at the Shipper’s expense.

9. Delivery

Delivery times provided by the Carrier are estimates and are not guaranteed unless explicitly stated otherwise.

The Carrier is not responsible for delays caused by customs, weather, or other factors beyond its control.

If the Consignee is unavailable or refuses the delivery, the Carrier will attempt redelivery, subject to additional charges.

10. Claims for Loss or Damage

Any claims for loss or damage to Goods must be submitted to the Carrier within [7 days] of receipt of the Goods by the Consignee.

Claims must include the original bill of lading, proof of value, and any supporting documentation.

The Carrier reserves the right to inspect the damaged Goods before settling any claim.

11. Limitation of Liability

The Carrier’s liability is limited to the value of the Goods declared by the Shipper or the standard liability amount as provided in these Terms and Conditions. The Carrier will not be liable for:

Any loss of income, profit, or market

Indirect, incidental, or consequential damages

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of [Insert jurisdiction], without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from or in connection with these Terms and Conditions will be settled through mediation or arbitration in [Insert jurisdiction], unless the parties agree otherwise.

14. Amendments

15. Force Majeure

The Carrier will not be liable for any delay or failure to perform its obligations under this agreement due to circumstances beyond its reasonable control, including acts of God, war, terrorism, labor disputes, government actions, or pandemics.
